WHAT IS MEDIATION - FAMILY DISPUTE RESOLUTION?
Mediation is an effective way to resolve disputes. It is a voluntary and confidential process used to find realistic and practical solutions for all types of issues. The process of mediation can help people make decisions following separation, including around parenting, property, financial and other relationship matters. Mediation in the context of family law is specialised and is commonly known as family mediation or family dispute resolution (FDR).

STEPS IN THE PROCESS
INITIAL CONTACT
The first step is for you to contact us to arrange your initial appointment.
INITIAL INDIVIDUAL APPOINTMENT
An initial individual meeting will take place with you and the other person separately and confidentially. At your initial meeting, we will spend around an hour and a half listening to your concerns and what you are hoping to achieve from mediation. We will also discuss the process and consider if it will be helpful in your situation.
SUBSEQUENT APPOINTMENTS
If appropriate, we can then arrange a mediation meeting. This meeting may take place together or in separate spaces, and possibly include support people and lawyers. During the first mediation, we will help develop a list of topics for discussion and encourage respectful discussions on each issue. Our experienced practitioners will keep the discussions on track and focus on the future, and where there are children, focus on your children. We generally set aside three hours for each mediation. Sometimes all issues are resolved at the first one; however, in most matters, the process can take two or three meetings.
AGREEMENT
If you can both think flexibly and compromise, it will hopefully allow you to reach agreements that you can live with and which enable you to move on with your lives. Agreements reached in mediation are not legally binding unless you apply for consent orders or enter into a binding financial agreement (for property matters). This documentation usually involves a family lawyer. For children’s matters, we can assist you in preparing a parenting plan.
